ENVIRONMENTAL RISKS You may be liable for significant remediation costs related to soil and
groundwater contamination by lead, asbestos, radon, storage tanks, landfills,
and other hazards. The Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) includes sellers and buyers in the liability chain even
though they may not be personally responsible for contamination on their
property.
LIMITING LIABILITY You may avoid costly environmental liability by the 'innocent landowner
defense' provision of CERCLA. However, in order to qualify for this defense,
environmental conditions must be investigated using 'due diligence' and 'all
appropriate inquiry'. A Phase 1 Environmental Site Assessment (ESA) from MTC
will meet the strict CERCLA requirements and limit your liability.
DUE DILIGENCE
Limiting liability requires an investigation with 'due diligence' into
environmental conditions on the subject property. You may be assured of 'due
diligence' from an MTC Phase 1 Environmental Site Assessment. Our ESA's meet the
rigorous standards established by
ASTM E1527 and are performed by a Certified
Environmental Inspector.
ALL APPROPRIATE INQUIRY The Environmental Assessment Association (EAA), an internationally recognized
body, certifies our inspectors, assuring �all appropriate inquiry� will be made.

research, and an extensive search of local, state, and federal environmental
